monoCO Terms of Service

These Terms of Service (“Terms”) govern your use of monococollective.com, monoCO photographer accounts, photography calls, galleries, and related services (collectively, the “Service”). monoCO is operated by Benjamin Hernandez (“monoCO,” “we,” “us,” or “our”).
By creating an account, submitting work, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Eligibility
You must be at least 18 years old and legally able to enter into these Terms. By using an account or submitting work, you represent that you meet these requirements.
The Service
monoCO currently provides a curated photography platform that may include:
• Monthly monochrome photography challenges.
• Featured Photographer submissions and editorial features.
• Public galleries and Editor’s Picks.
• Photographer accounts and reusable profile information.
• Transactional notices and optional newsletters.
Features, schedules, categories, selection methods, and availability may change. Unless a specific offering expressly states otherwise, participation does not guarantee selection, publication, critique, promotion, or any commercial opportunity.
Accounts
You agree to provide accurate information and keep it reasonably current. You are responsible for protecting your sign-in credentials and for activity performed through your account. Notify hello@monococollective.com if you believe your account has been compromised.
You may request account deletion through the account settings or by contacting monoCO. Deleting an account does not necessarily require deletion of material already lawfully published, editorial records that monoCO reasonably needs to retain, or information retained to meet legal or security obligations. We will explain the applicable scope when processing a request.
monoCO may restrict or terminate access when reasonably necessary to protect the Service, other participants, or monoCO; address unlawful activity; or respond to a material violation of these Terms.
Submission Requirements
Current Monthly Challenge rules permit up to one photograph per available category, subject to the rules displayed for the active call. Monthly Challenge uploads must currently be JPG, PNG, or WebP files no larger than 5 MB each. Other calls, including Featured Photographer submissions, may have different image-count, format, deadline, category, or technical requirements shown on their submission form.
When you submit content, you represent that:
• You created the work or otherwise hold all rights needed to submit and authorize its permitted use.
• The content and its publication do not infringe copyright, privacy, publicity, contractual, or other rights.
• You have obtained any permissions reasonably required for identifiable people, private locations, or protected material depicted in the work.
• The information and attribution you provide are accurate.
• The submission does not contain unlawful, abusive, hateful, exploitative, deceptive, or malicious material.
monoCO may reject, remove, or decline to publish any submission, including work that does not meet a call’s requirements or monoCO’s editorial and community standards. Editorial decisions are discretionary and are not subject to public voting unless a call expressly says otherwise.
Ownership and License
You retain copyright and ownership of your photographs. Submitting work does not transfer that ownership to monoCO.
By submitting content and accepting the applicable submission agreement, you grant monoCO a non-exclusive, worldwide, royalty-free license to store, review, reproduce, resize, crop where reasonably necessary for presentation, and display the submitted content for administering the call and evaluating the submission.
If monoCO approves or selects the work for publication, that license also permits monoCO to publish and promote the selected work, with reasonable attribution, through the monoCO website, galleries, editorial features, newsletters, and monoCO-controlled social channels. This publication license is limited to presenting and promoting monoCO, the applicable call, the selected work, and the photographer. It does not permit monoCO to sell ownership of your photograph or license it to unrelated third parties as stock imagery.
The license continues for material already published and for reasonable archival uses. You may request that monoCO stop future promotional use or remove material from channels monoCO controls. monoCO will consider reasonable removal requests, subject to editorial archives, technical limitations, legal obligations, and copies outside monoCO’s control.
You permit monoCO to use the display name, handle, title, statement, and other attribution information supplied with approved work for those same purposes.
monoCO Materials
The monoCO name, logos, site design, software, editorial copy, and other materials created by monoCO are owned by monoCO or its licensors. These Terms do not grant you permission to use monoCO branding or materials except as necessary to use the Service or as monoCO separately authorizes.
Optional Communications
Marketing and newsletter communications are optional and separate from service-related messages. If you opt in, you may unsubscribe at any time. Account verification, password, submission receipt, moderation, and publication messages may still be sent when necessary to provide services you request.
Privacy
The monoCO Privacy Policy (https://www.monococollective.com/privacy) explains how monoCO handles personal information and is incorporated into these Terms by reference.
Availability and Changes
monoCO is an evolving service. We may add, change, suspend, or discontinue features and may update call rules before a call opens. We will not knowingly apply a materially different publication permission retroactively to work already submitted without an appropriate basis or additional consent.
We may update these Terms. Updated Terms will be posted with a revised date, and additional notice will be provided when a change is material. Changes apply prospectively from their effective date.
Disclaimers
The Service is provided on an “as available” basis. To the extent permitted by applicable law, monoCO does not guarantee uninterrupted availability, selection or publication of any submission, specific audience reach, preservation of third-party links or social posts, or any particular creative, professional, or commercial result.
Nothing in these Terms excludes rights or remedies that cannot lawfully be excluded.
Responsibility for Claims
You are responsible for claims arising from content you submit, your lack of required rights or permissions, or your material violation of these Terms. monoCO remains responsible for its own conduct as required by applicable law.
Resolving Concerns
Please contact monoCO first at hello@monococollective.com so we can try to resolve account, submission, copyright, privacy, or service concerns informally. These Terms do not require binding arbitration and do not waive rights that applicable law provides.
General Terms
If a provision of these Terms is found unenforceable, the remaining provisions remain in effect to the extent permitted by law. A failure to enforce a provision is not a waiver of it. These Terms and the Privacy Policy are the agreement between you and monoCO concerning the Service, except where a specific call or offering includes additional disclosed terms.
